No. I’ve thought about this at length. When he was posting on The Free Press I used to think he was really Bill Maher. Then I thought he was Jerry Seinfeld, or Adam Sandler, or Bill Murray, or Nate Bargatze. I thought he had to be someone famous who couldn’t use his real name because of the stuff he was writing. But now I just think he’s a prominent person in his community and can’t risk his reputation or business. This is the world we live in now. How sad. The democrats are so evil they’ll ruin you if you speak the truth.
I realize this is satire, good satire at that, and satire is your shtick, but as a woman who went to law school I think her reasoning was fairly sound. The amendment says what it says. Did they eff up by writing it that way? You betcha. But if we want the Constitution respected and followed as written then we gotta follow it as written. I think the solution is a Constitutional amendment that repeals it. And it seems to me that the iron is hot so the striking is good. And lest the naysayers begin, I never believed that Roe would be overturned. But a steady, consistent, persistent assault prevailed. This can be the same.

It is totally not legitimate to interpret it the way she interpreted it because that interpretation requires us to pretend we don’t know what the drafters of the amendment meant when they wrote it.
Obviously, born in the United States and subject to the jurisdiction thereof are two different things and we know this because the word “and” is there and we know what the word “and” means. Even if I’m wrong on all of that, in no sense is it the Supreme Court’s job to codify absurd legal loopholes based on word games. I guess I have the right to chop the arms off bears because of the Second Amendment? Too bad for the bears that they screwed up and worded it that way…….

Just a guess on my part but I’m thinking that when Congress wrote this Amendment the fact that a pregnant woman could have her first contractions in Europe and deliver that baby in the U.S. was not a possibility.
My understanding is that Kavanaugh took the position that Congress can solve this without another amendment with a statute defining what you “get” if you are born here to temporary noncitizen parents. And that Trump et al are following up on this.
